Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Homeschool Genius (“Service”), operated by OffByOne LLC (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Acceptable Use Policy. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You are responsible for accurate registration information and for maintaining the confidentiality of your sign-in credentials.

The Service lets you upload notes, photos, documents, and other materials (“User Content”). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, scan, and display your User Content solely as necessary to operate the Service — including automated content-safety scanning described in Section 5.

You represent and warrant that you have the rights necessary to upload and share each piece of User Content, that it does not infringe any third-party rights, and that it complies with the Acceptable Use Policy.

You must follow our Acceptable Use Policy. Violations may result in immediate removal of content, suspension or termination of your account, and reporting to law enforcement where required by law.

We use automated systems (including third-party image-classification services) and may use human reviewers to scan User Content for material that violates our Acceptable Use Policy or applicable law. Content flagged as likely-violating may be quarantined, removed, or blocked from display while we review. We are under no obligation to monitor User Content but reserve the right to do so.

We have zero tolerance for child sexual abuse material (“CSAM”) or any content that sexualizes minors. As required by 18 U.S.C. §2258A, suspected CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline, and we cooperate with law enforcement. Accounts associated with such uploads are immediately terminated.

We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”). Send notices to our designated agent at the address on file with the U.S. Copyright Office, with a copy to dmca@homeschoolgenius.org. Repeat infringers' accounts will be terminated.

We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or the Acceptable Use Policy, or if continued access poses a risk to us, other users, or third parties. You may stop using the Service at any time; on request we will delete your account and associated data within a commercially reasonable period (subject to legal retention requirements).

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars (US$100). We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill.

You agree to defend, indemnify, and hold harmless OffByOne LLC and its affiliates, officers, employees, and agents from claims arising out of (a) your User Content, (b) your use of the Service, or (c) your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in North Carolina, and you consent to jurisdiction and venue there.

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use after changes take effect constitutes acceptance.
